(Published in the McAlester News-Capital on June 30th, 2017.) ORDINANCE NO. 2604 AN ORDINANCE ADOPTING THE BUDGET OF THE CITY OF McALESTER, OKLAHOMA FOR THE FISCAL YEAR 2017-2018. WHEREAS, the City of McAlester, Oklahoma completed and placed on file with the City Clerk a proposed budget and estimate of the amount of moneys required to meet the public expenses, bond retirement and interest, reserve funds and expenses of the City for the fiscal year 2017-2018; and WHEREAS, a notice was published that the City Council for the City would meet on June 6th, 2017, at the hour of 5:30 p.m., in City Council Chambers at City Hall of the City of McAlester for the purpose of giving citizens within the limits of said city an opportunity to be heard in a public hearing upon said budget; and WHEREAS, Article 5, Section 5.06 (1) of the City Charter requires that the budget to be adopted by ordinance; and WHEREAS, this Ordinance is meant to adopt the budget for fiscal year 2017-2018 in ordinance form in accordance with the City Charter. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF McALESTER, OKLAHOMA AS FOLLOWS: Section 1. The budget of the City of McAlester, Oklahoma for the fiscal year 2017-2018 is hereby adopted at the departmental level, which budget shows total resources available in the amount of $80,618,709 with $37,785,493 of that being estimated beginning fund balance and $42,833,216 as current year revenues along with fund/departmental budgeted appropriations of $43,139,776 with $9,756,759 of that being transfers to other funds leaving a total in the amount of $37,478,933. Section 2. Budgeted resources, including any appropriated fund balance for each separate fund of the City of McAlester, for the fiscal year 2017-18 are set forth in summary in the attached exhibit, and are hereby appropriated for expenditure at the departmental level during the fiscal year 2017-2018. Section 3. The City Council does hereby authorize the City Manager to transfer any unexpended and unencumbered appropriations, at any time throughout FY 2017-2018, within a fund, subject to a dollar limitation of $25,000 and notification to the City Council and the Audit and Finance Advisory Committee, in writing. Section 4. The City Clerk is directed to transmit a copy of this budget ordinance hereby adopted to the State Auditor and Inspector’s Office. Section 5. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City of McAlester hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact of any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional or invalid. Section 6. That an emergency is hereby declared to exist, and for the preservation of the public peace, health and safety, by reason whereof it is necessary that all acts take effect immediately and be in full force and effect from, and after the passage and approval.
